1. Mobile Message Service

The Active Peaks mobile message service (the "Service") is operated by Active Peaks ("Active Peaks", "we", or "us"). By using the Service, you agree to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features at any time without notice. To the extent permitted by applicable law, we may also update these Mobile Terms, and your continued use of the Service after any changes constitutes your acceptance of those changes.

2. Consent to Receive Messages

By opting in to Active Peaks’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Active Peaks to the mobile number you provided, including through your wireless provider. Messages may be sent using automated or manual messaging technology.

These messages may include service-related updates (such as order updates and account notifications) as well as promotional content (such as special offers, discounts, and cart reminders).

You understand that consent to receive messages is not a condition of any purchase, and your participation in this program is entirely voluntary.

3. Message Frequency and Charges

We do not charge for the Service. However, you are responsible for any fees or charges imposed by your wireless provider. Message frequency may vary depending on your interaction with our services. Message and data rates may apply.

4. Opt-Out Instructions

You may opt out of the Service at any time by texting STOP to ActivePeaks or by using the unsubscribe link provided in any message (where available). After opting out, you will receive a one-time confirmation message, and no further messages will be sent unless initiated by you.

If you are subscribed to multiple Active Peaks messaging programs, you will need to opt out of each program separately by following the relevant instructions, unless otherwise required by applicable law.

5. Support and Assistance

If you need assistance, you can text HELP to ActivePeaks or contact our support team via email at support@activepeaks.com.

6. Changes to Numbers or Short Codes

We may change the phone number or short code used to operate the Service at any time. We will notify you of such changes where required. Messages sent to outdated numbers or short codes, including STOP or HELP requests, may not be received, and we are not responsible for processing such requests.

7. Carrier Disclaimer

Wireless carriers supported by the Service are not liable for delayed or undelivered messages.

8. User Responsibilities

You agree to provide a valid and accurate mobile number when subscribing to the Service. If you change your mobile number, you must re-subscribe using your new number.

9. Limitation of Liability

To the extent permitted by applicable law, Active Peaks is not liable for any failed, delayed, or misdirected delivery of messages, any errors in the information sent, or any actions you take based on the messages or the Service.
